Privacy Policy

A K Brown Refrigeration and Air Conditioning Ltd. and (client or service provider) agree that Personal information will be collected, used and transferred according to the provisions of any applicable privacy legislation. For purposes of this contract, “Personal Information” shall mean any information about an identifiable individual that is collected, used, transferred or disclosed by (client or service provider) in relation to the performance of the Services. (Client or Service Provider) acknowledges that A K Brown is the primary collector of Personal Information and is deemed to be the custodian of such Personal Information pursuant to applicable privacy legislation.

(Client or Service Provider) agrees that in respect of Personal Information collected, used and disclosed to or by (Client or Service Provider) in connection with the provision of services to A K Brown or with the provision of services to individuals for which (Client or Service Provider) has been retained by A K Brown, (Client or Service Provider) shall comply with all applicable privacy protection laws and without limiting the generality of the foregoing, (Client or Service Provider) covenants that it will:

  • Keep all information in strict confidence and shall not disclose such information to a third party or use it for any purpose other than for the purpose for which it was provided to (Client or Service Provider), unless A K Brown or the individual otherwise consents to (Client or Service Provider) in writing.
  • Take all reasonable steps to protect the personal information in (Client or Service Provider’s) possession from loss or unauthorized use, access or disclosure.
  • Upon the termination of services to/by A K Brown and/or in accordance with directions received from A K Brown from time to time, return all Personal Information currently in (Client or Service Provider’s) possession to A K Brown or destroy all specified Personal Information currently in (Client or Service Provider’s) possession (whether provided directly, or indirectly to you by A K Brown).
  • Where personal information is collected directly from an individual by (Client or Service Provider) in connection with the provision of services, limit such collection and use of such personal information to that which is reasonably necessary to perform such services.

A K Brown agrees to provide or cause A K Brown’s agents to provide, as the case may be, Personal Information to (Client or Service Provider) in relation to the Services in accordance with any such applicable legislation and, where required by law, to obtain the prior consent of any individual whose Personal Information shall be disclosed by A K Brown or its agents, as the case may be, to (Client or Service Provider).

(Client or Service Provider) shall defend and hold A K Brown harmless against any claim or complaint whatsoever that may be filed or presented by any third party with regard to any right whatsoever involving that Personal Information, to the extent the claim or complaint is attributable to (Client or Service Provider’s) breach of its obligations under this Section. This warranty by (Client or Service Provider) includes the reimbursement to A K Brown of any and all related costs and legal expenses that A K Brown may incur in order to protect its interest and legal rights in such a situation.
